TERMS AND CONDITIONS OF BUSINESS
1. INTRODUCTION:
Arrangement of an interview with a Leading Edge Consulting candidate by a Client will constitute acceptance of the terms and conditions of business as stated in this document.
2. FEES:
Fees are calculated as a percentage of the successful candidate’s expected first year’s remuneration and in cash and in kind, according to the rates specified below.
Where the remuneration / compensation includes Commission or other performance related components, bonuses / incentives, a realistic estimate of the first years earnings will be agreed upon between Leading Edge Consulting and the client.
When a client grants the use of a motor vehicle as distinct from a travelling allowance, the value of this benefit is set at R24000.00 per annum and added to the package.
Rates: All packages 15%
Should a client enter into negotiations with any candidate submitted by Leading Edge Consulting within 9 (nine) months of the date on which the candidate’s documents were received, then a full fee is payable to Leading Edge Consulting regardless of the date on which the candidate commences employment. These conditions also apply should a candidate be assisted by a client to find remunerative work in any way whatsoever.
3. LEADING EDGE CONSULTING GUARANTEE
Leading Edge Consulting provides a 100% full reimbursement guarantee on all placements should the candidate resign or be dismissed within 60 (sixty days) of commencing employment. This guarantee only applies if Leading Edge Consulting is notified within 7 days in writing of the candidate leaving. The exclusions being, redundancy or retrenchment, unfair dismissal, breach of employment contract by employer, mergers and collusion to avoid fee payment. Should the account not be settled within 30 (thirty) days of the official start date, it shall be deemed that the guarantee has been waivered by the client.
4. WARRANTY
Leading Edge Consulting makes every effort to ensure the correct and concise details of all introduced candidates with regard to skills, qualifications, state of health and integrity. The responsibility of the final selection of a prospective employee rests solely with the client. Leading Edge Consulting shall not be held responsible for any damages or losses that may arise due to the actions of a candidate introduced by Leading Edge Consulting.
5. CLAUSE CONFIDENTIALITY
Clients are reminded that candidate’s particulars are forwarded to them in the strictest confidence. Current employers must not be contacted without the specific prior consent of the concerned candidates.
6. PAYMENT
Leading Edge Consulting shall invoice the client on the commencement date of the candidate. Payment of the invoice must be received within 30 (thirty) days. The fee will be subject to VAT (if the company is based in South Africa) and will be shown separately on the invoice. Should the client fail to pay the full placement fee, the client will be liable for any legal costs incurred by Leading Edge Consulting in order to attain the due fee. The Company reserves the right to charge interest at the rate of 2% per month on any outstanding monies.
7. ACKNOWLEDGMENT
The client or its representative hereby acknowledges, agrees with, and has authority to bind the client to the terms and conditions of this contract upon arrangement of interview with the candidate.
8. VARIATIONS
No variations of these terms and conditions shall be binding unless received in writing and signed.
